General conditions of sale

The present Générales conditions of Sale (hereafter CGV) apply to the sale contracts concluded between the company Antoine JULIEN registered in France and the customers from his site of electronic trade accessible by the www.montventoux.com address. The site is the property of the company Antoine JULIEN in his totality (images, texts and graphics), as well as the whole of the rights y related. Any reproduction, integral or partial, are systematically subjected to the authorization of the owners. However, the connections of the hypertexts type towards the site are authorized without specific request.

Acceptance of the general conditions of sale

The fact for a user of connecting themselves on the site, of filling the purchase order and of confirming the order is worth acceptance full and whole CGV. The present CGV are applicable to any operation relating to the products and this whatever the place of their final destination. Montventoux.com selects and markets products resulting from the craft industry of Provence and meeting standards of quality. The essential characteristics of the products appear by means of photographs and of text illustrating the articles presented. The photographs could not be regarded as contractual.

Order

To order the customer selects one or more products on the site. This constitutes a commercial proposal for a sale of products within the limit of stocks available which cannot in no case to be considered juridically as a permanent offer. The order is carried out by the validation by the customer of the purchase order recapitulating the whole of the conditions of sale and the payment of the price. Montventoux.com will immediately confirm to the customer the acceptance of his order by e-mail. Montventoux.com also reserves the possibility of informing the customer of possible difficulties of provisioning of a product and of refusing its order if necessary. In this case and if the customer carried already out his payment, Montventoux.com will forward some to him refunding under 30 days.

Price

Prices indicated on the www site. montventoux.com. are prices in euros and indicated including all taxes. In fact the present prices at the time of the consultation, of the order by the customer and will be applied to the moment of the invoicing.

VAT

Prices including all taxes are the prices including the VAT at the French rates into force at the time of the invoicing and are the prices applied for any order delivered in a European member country of the Community

Transport charges

The transport charges are not included in the price of the products, these expenses vary according to the weight and from the place of delivery and are the responsibility of the customer. The carriage costs which are to you invoicees are systematically indicated before the validation of your order. You will not have any expenses additional to pay with the delivery or after validation of your order.

Delivery periods

You profit with montventoux.com from delivery periods fast (48 H for France métropolitaire). The deliveries are ensured by the operators of the group the Post office: Colissimo for the countries covered by this service, Chronopost for the others. The time before reception of your order depends on two elements: the availability of the product and the delivery period after handing-over to the conveyor. The announced times get along starting from the handing-over with the conveyor and thus out possible waiting of availability of the product. In the event of absence during the delivery a transit advice note is deposited in your letter-box. You will be able to then withdraw your parcel in the post office nearest to the address of delivery, during 15 days, on presentation of the transit advice note. You will be informed by e-mail as of handing-over of your order to the conveyor. In the event of complaint, the customer must express precise reservations in writing on the delivery order of the conveyor and confirm them at the latest in the 24 hours by e-mail or letter registered with AR to Montventoux.com.

Mode of payment

The payment of the price is carried out the cash at the time of the order and by bank card (visa, mastercard, eurocard…) The customer accepts by advance and without reserve that Montventoux.com proceeds to the protected transaction. The order will then be dispatched only after report of the payment. An invoice will be given to the purchaser with his parcel.

Retractation

In accordance with the L121-16 article of the code of French consumption, the customer has a time of 7 days retractation frank as from the day of delivery of the ordered good. The request for refunding will have to be done either by e-mail or by letter registered with AR. Transport charges and other expenses (tax, customs…) engaged for the return to Montventoux.com are the responsibility of the customer. The product will have to be turned over in its packing of origin, in perfect state, not used without marking of some kind that it is accompanied by a copy of the delivery order. The refunding of the products is due within 30 day as from the date of reception at Montventoux.com provided that it is not noted any anomaly.

Responsibility

The customer is only responsible for the choice of the products, of their conservation as from the their use and delivery date. In the same way, Montventoux.com could not be held responsible for the non-observance of the legislative or lawful provisions into force in the country of delivery, Montventoux.com being only responsible for the respect of the French regulation relating to the products.

Protection of your personal data

The information of the personal information collected for purposes of the remote sale is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The defect of information involves the not-validation of the order. In accordance with Data-processing law the “and Freedoms”, the personal data processing relating to the customers was the declaration object near the National Commission of Data processing and Freedoms (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, of modification, correction and suppression of the data which relate to it, that it can exert at Montventoux.com. Moreover, Montventoux.com is committed not communicating, free or with counterpart, the co-ordinates of its customers to a third.

Court of jurisdiction

The sale contract concluded between Montventoux.com and its customer as well as the present General Conditions from Sale are governed by the French right. Very different or remaining litigation will be competence of the Commercial court of Avignon.
